Obamacare at Supreme Court: Healthcare Stocks ... - Investing Daily

Healthcare stocks ? as measured by the Health Care Select Sector SPDR (NYSE: XLV) ? have struggled during the first quarter of 2012, rising only 8.2% which trails the S&P 500?s 12.2% gain by almost one-third. Concerns over pharmaceutical patent cliffs and the upcoming U.S. Supreme Court ruling on the constitutionality of Obamacare have weighed on healthcare stocks. In fact, healthcare has been the third-worst-performing industry sector out of the nine sector SPDRs:

Obamacare is Unconstitutional

Why the sudden reversal of fortune in healthcare stocks? The answer lies with the U.S. Supreme Court, which held oral arguments this week in the Obamacare case. There are two major constitutional issues under review:

  1. Individual mandate requiring every U.S. citizen to buy health insurance
  2. Severability of Obamacare if individual mandate provision is struck down

Forcing the uninsured to buy insurance would be the first time in U.S. history that a U.S. citizen would be penalized for ?inactivity? ? refusing to buy something they didn?t want. Proponents of the mandate often trot out the regulatory requirement to buy auto insurance, but only people who drive a car are required to buy such insurance; drivers have taken an affirmative action to enter the car market and hence subject themselves to regulation. In contrast, people forced to buy health insurance have done nothing at all except be alive.

Consequently, the individual mandate is a gross abuse of the U.S. Constitution?s Article 1, Section 8, Clause 3 ?Commerce Clause,? which strictly limits federal regulation to commerce ?among the several states.? Ever since Congress passed the McCarran-Ferguson Act in 1945, insurance has always been regulated by the states, not the federal government.

The Supreme Court Will Likely Strike Down Obamacare

Observers of the oral argument have uniformly stated that a majority of Supreme Court justices appeared critical of the individual mandate provision and challenged the government lawyer defending the law much more harshly than they did the arguments of the contesting plaintiff lawyer. Justice Kennedy ? commonly known as the 5-4 ?swing vote? on the bench ? asked the following question of Obama?s lawyer on pages 11-12 of the transcript:

This is unprecedented, this is a step beyond what our cases have allowed, the affirmative duty to act, to go into commerce. If that is so, do you not have a heavy burden of justification?

You are changing the relation of the individual to the government in a unique way. The reason this is concerning is because it requires the individual to do an affirmative act. In the law of torts, our tradition, our law has been that you don?t have the duty to rescue someone if that person is in danger. The blind man is walking in front of a car and you do not have a duty to stop him, absent some relation between you.

Based on academic research, the Supreme Court has historically been much more likely to rule against the side it asks more questions of during oral arguments. A ?state of the art? model based on oral-argument language and tone predicts that the Supreme Court will declare the individual mandate unconstitutional by a slim 5-4 margin.

Obamacare is highly unpopular with the American people. In a recent poll, 75 percent of Americans wanted the Supreme Court to strike it down.? Ironically, even Obama opposed an individual mandate during the 2008 presidential campaign before doing a 180-degree flip-flop once he was elected president. On the other hand, the public overwhelmingly supports barring insurance companies from denying health coverage based on a pre-existing condition by an 85-15 margin.

Pre-Existing Condition Protection Doesn?t Work Without Individual Mandate

The problem is that you can?t have one without the other without destroying the profitability of insurance companies. Absent an individual mandate, the result will be ?adverse selection,? whereby healthy people will opt out of the insurance program while sick people will enroll. A profitable insurance market is based on uncertainty where more people pay into the system than is paid out in claims.? If the only people who enroll are those who are certain to make reimbursement claims based on pre-existing conditions, insurers will end up losing money because the government-regulated insurance premiums won?t be sufficient to cover all of the claims. In their 11th-Circuit Court of Appeals brief (page 30), Obama?s own lawyers have cited Princeton University professor Uwe Reinhardt for the proposition that:

It is well known that guaranteed issue coupled with voluntary insurance tend to lead to a death spiral of individual insurance.

For this reason, the Obama administration has argued that requiring insurance companies to accept pre-existing conditions should not survive if the individual mandate is struck down.

Obamacare Will Be Upheld or Struck Down in Its Entirety ? No Severability

On the third day of oral argument, the issue of severability was debated and my reading of the transcript leads me to believe that many of the justices believe that Obamacare must be struck down in its entirety if the individual mandate is struck down. For example, on page 41 of the transcript Justice Alito asked the best question:

Insurance reforms impose 10-year costs of roughly $700 billion on the insurance industry, and that these costs are supposed to be offset by about 350 billion in new revenue from the individual mandate and 350 billion from the Medicaid expansion. Now if the 350 billion from the individual mandate were to be lost, what would happen to the insurance industry, which would now be in the hole for $350 billion over 10 years?

In Healthcare Reform: the $700 billion Lie, I argued that the cost of Obamacare will be much greater than advertised, but even taking that understated number at face value greatly concerned swing vote Justice Kennedy, who exhibited sympathy for Alito?s question. Kennedy asked a follow-up question on pages 42-43 of the transcript:

I still don?t understand where you are with the answer to Justice Alito?s question. Assume that there is a substantial probability that the 700 billion is going to be cut in half if the individual mandate is stricken. Assume there is a significant possibility of that. Is it within the proper exercise of this Court?s function to impose that kind of risk [on the insurance industry]? Can we say that the Congress would have intended that there be that kind of risk?

I think the reason healthcare stocks have rallied so strongly this week is because investors have concluded that the entire Obamacare monstrosity is going to be struck down ? not just the individual mandate, but also the requirement to enroll people with pre-existing conditions, the expansion of Medicaid, and the medical loss ratio minimums that limit insurance company profits to 20% of insurance premiums collected.

Healthcare Stocks Look Like a Buy

Bottom line: healthcare insurers were going to do fine under Obamacare because the individual mandate and Medicaid expansion requirements promised to greatly increase industry revenues and counteract the pre-existing condition and medical loss ratio cost burdens. Similarly, healthcare insurers will do fine if Obamacare is struck down because free markets allow companies to generate profits unrestricted.

The only scenario where healthcare insurers were going to be hurt badly was if the individual mandate was struck down but the pre-existing condition and medical loss ratio provisions remained (i.e., severability). Since severability is almost certainly off the table given what transpired this week during the U.S. Supreme Court?s oral argument, investors have a ?green light? to invest in healthcare stocks regardless of whether Obamacare is upheld in its entirety or struck down in its entirety.

?All or nothing? ? the key to healthcare profitability ? appears assured.

Things could be getting a tad bit messy for the world's richest man, Carlos Slim, as Mexico's CFC (or Federal Competition Commission) has ruled one of his companies holds too much power in a key wireless sector. The CFC's beef with Telcel isn't exactly novel; earlier this year the antitrust agency served the phone outfit with an 11,989,000,000 pesos fine (around a $1 billion) for "monopoly practices." Telcel's latest troubles date back to 2011, when the CFC deemed the company "too dominant" in the mobile call termination game, and now it's taken a unanimous vote that'll allow it to implement "asymmetric" regulations on Telcel's service quality, charges and information. Not all is lost for Slim's carrier, however, since it could still appeal the CFC's decision.

Warming has led to changes in climate extremes such as heat waves, record high temperatures and, in many regions, heavy precipitation since 1950, the U.N. climate panel warned in a report Wednesday.

"It is very likely that there has been an overall decrease in the number of cold days and nights, and an overall increase in the number of warm days and nights, at the global scale," the scientists wrote.

Some populations are already living on the edge?of disaster, given the projected increases in the magnitude or frequency of some extreme events in many regions, the report stated.

"Small increases in climate extremes above thresholds or regional infrastructure 'tipping points' have the potential to result in large increases in damages to all forms of existing infrastructure," the experts said.


In the past, the Intergovernmental Panel on Climate Change has focused on the?gradual rise of temperatures and oceans. This report is the first to look at less common but far more noticeable extreme weather changes, which lately have been costing on average about $80 billion a year in damage.

The study forecasts that some tropical cyclones -- which include hurricanes in the United States -- will be stronger, while the frequency might diminish.

"Average tropical cyclone maximum wind speed is likely?to increase, although increases may not occur in all ocean basins," the experts?stated. "It is likely that the global frequency of tropical cyclones will either decrease or remain essentially unchanged."

Some other specific changes in severe weather that the scientists said they had the most confidence in predicting include more heat waves and record hot temperatures worldwide and increased downpours in Alaska, Canada, northern and central Europe, East Africa and north Asia.

"We mostly experience weather and climate through the extreme," said one of the report's top editors, Chris Field, an ecologist with the Carnegie Institution of Washington. "That's where we have the losses. That's where we have the insurance payments. That's where things have the potential to fall apart.

"There are lots of places that are already marginal for one reason or another," Field said. But it's not just poor areas: "There is disaster risk almost everywhere."

At 592 pages long, the report elaborates on a summary of findings released last November.

The report specifically points to New Orleans during 2005's Hurricane Katrina, noting that "developed countries also suffer severe disasters because of social vulnerability and inadequate disaster protection."

In coastal areas of the United States, property damage from hurricanes and rising seas could increase by 20 percent by 2030, the report said. And in parts of Texas, the area vulnerable to storm surge could more than double by 2080.

Already, U.S. insured losses from weather disasters have soared from an average of about $3 billion a year in the 1980s to about $20 billion a year in the last decade, even after adjusting for inflation, said Mark Way, director of sustainability at insurance giant Swiss Re. Last year that total rose to $35 billion, but much of that was from tornadoes, which scientists are unable to connect with global warming. U.S. insured losses are just a fraction of the overall damage from weather disasters each year.

The scientists say that some places, particularly parts of Mumbai in India, could become uninhabitable from floods, storms and rising seas. In 2005, over 24 hours nearly 3 feet of rain fell on the city, killing more than 1,000 people and causing massive damage. Roughly 2.7 million people live in areas at risk of flooding.

The IPCC and former Vice President Al Gore won the 2007 Nobel Peace Prize for their efforts around climate change.

Angelina College Visual Arts majors will display their works in an exhibition opening Tuesday, April 3rd and running through April 11th in the Angelina Center for the Arts Gallery located on the AC campus.

A reception for the artists will take place from 6?7:30 p.m. on Tuesday, April 3rd.

Students from Mrs. Robbie Roach?s Basic Design (ARTS1311) and Mr. Clint Alexander?s Life Drawing (ARTS2316) classes will offer various art mediums in this gallery.

Angelina College Visual Arts students will present their works in an exhibition scheduled to open Tuesday, April 3rd in the Angelina Center for the Arts Gallery. The gallery will run through April 11th and will feature works from students in Basic Design and Life Drawing courses.

Basic Design students will display works in various media, including collage and paint. Those students include Adrian Torres, Gabriel Tovar, Guy Schroeder, Matt Whitley, Lucas Thornton, Jerroderick Lenoir, Iris Cruz, Hayley Burt, Lacey Kroll, Michael Gumm, Genoveva Pasillas, Ashley Martin and Delesha Johnson.

Life Drawing students will be showing drawings in various media such as charcoal and graphite, drawn from the human figure. Those students are Dona Gibbs, Genoveva Pasillas, Ashley Martin, Jaime Medina, Yvette De La Garza, Amanda Dill, Joslyn Angton, Timothy Shane Smith, Jonathan Clos, Shauna Chapman, Zach Maberry, Tyler Dhone and Dianna Willis.

The gallery is open to the public, and there is no admission charge.

Finnish scientists have drawn on the structure of the insect's foot to exploit its ability to let the creature skim across a pond's surface.

The buoyancy of the material has been boosted by making it out of plant cellulose.

The properties that make it float could help it act like a powerful sponge to aid oil spill clean-ups, say its creators.

Five fridges

The material is a type of aerogel - substances in which the liquid has been replaced with a gas but the structural components are left in place. The lightest aerogels are only a few times denser than air itself and have been called "solid smoke".

The aerogel created by Dr Olli Ikkala and colleagues at the Helsinki University of Technology uses tiny fibres from plant cellulose - a natural polymer that, in some ways, resembles plastic.

Cellulose is typically used to make paper and cloth. Dr Ikkala's team have used a specially processed form of cellulose, known as nanocellulose, to form their gel.

"These materials have really spectacular properties that could be used in practical ways," said Dr Ikkala in a statement.

Early tests based on a cellulose aerogel constructed to a design suggested by the feet of the pond skater have revealed how buoyant it is. They speculate that a 500g chunk of the material could support five standard household fridges weighing about half a tonne.

The early work has also revealed that the material is a very efficient sponge that could aid oil spill clean-up efforts. Floating mats of the aerogel could be dragged through the water gathering up spilled oil which could then be recovered.

The research was unveiled at the spring meeting of the American Chemical Society.

Annan says Syria accepts peace plan, fighting enters Lebanon

BEIJING/BEIRUT (Reuters) - Syria has accepted a ceasefire and peace plan drawn up by U.N. and Arab League special envoy Kofi Annan, his spokesman said on Tuesday, even as Syrian troops thrust into Lebanon to battle rebels who had taken refuge there.

Annan conceded he faced a "long and difficult task" in ending the fighting, as rebel group leaders meeting in Turkey weighed how to unite their fractured movement and boost foreign backing for a year-old revolt against President Bashar al-Assad.

On a visit to Beijing, Annan told Chinese Premier Wen Jiabao that global cooperation with China and other countries was the only way to defuse the conflict, whose sectarian dimensions have raised fear it could spread and destabilise the wider region.

"I indicated that I had received a response from the Syrian government and will be making it public today, which is positive, and we hope to work with them to translate it into action," Annan told reporters after meeting Wen.

Annan's spokesman confirmed the Damascus had accepted the six-point peace plan, which the U.N. Security Council has endorsed and Annan called an "important initial step".

Annan said it dealt with "political discussions, withdrawal of heavy weapons and troops from population centres, humanitarian assistance being allowed in unimpeded, release of prisoners, freedom of movement and access for journalists to go in and out.

"We've had very good discussions about the situation in Syria and they (China) have offered their full support," he said. "They're going to work with me and the other members of the Council to ensure that the six-point plan is implemented.

"So we will need to see how we move ahead and implement this agreement that they have accepted," said Annan.

The former U.N. secretary general, who flew to China from Russia, was trying to persuade Assad's two most powerful allies to help advance his proposal which, crucially, does not insist on Assad stepping down right now - unlike previous plans which Moscow and Beijing vetoed at the Security Council. Arab leaders were expected to endorse it later this week at a Baghdad summit.

Annan appealed for Beijing's support and advice, according to a pool report. "And I know you've already been helpful but this is going to be a long difficult task and I am sure that together we can make a difference," Annan told Wen.

BORDER INCURSION

Underlining his uphill challenge, Syrian troops advanced into north Lebanon, destroying farm building and clashing with Syrian rebels holed up there, residents said.

They said Syrian forces crossed a few hundred metres into Lebanese territory. A security source in Beirut said clashes had taken place near the poorly marked border but did not confirm Syrian troops had entered Lebanon.

Shells hit north Lebanon last week and residents say Syrian troops have briefly crossed the frontier while pursuing fleeing rebels in recent months.

"More than 35 Syrian soldiers came across the border and started to destroy houses," said Abu Ahmed, 63, a resident of the mainly Sunni Muslim rural mountain area of al-Qaa.

Another resident said that the soldiers, some travelling in armoured personnel vehicles, fired rocket-propelled grenades and exchanged heavy machinegun fire with rebels. He said soldiers destroyed one house with a bulldozer.

The Lebanese army blocked off the area, where hundreds of Syrian refugees -- some of them active members of the rebel Free Syrian Army -- have fled a year-long revolt by mostly Sunni Muslim Syrians against Assad, a member of his country's Alawite minority, an offshoot of Shi'ite Islam.

Residents said the Syrian troops remained 200-500 metres inside Lebanese territory.

The United Nations says more than 8,000 people have been killed in Syria's upheaval over the past year. Syrian authorities blame foreign-backed terrorists for the violence and say 3,000 soldiers and police have been killed.

Western and Arab governments which would be glad to see Assad ousted are wary of what might replace the 40-year-old family dynasty and its ruthless but predictable police state.

Security appears to be fraying in many parts of Syria despite repeated army offensives to regain rebellious territory. Activists said the government was struggling to hold such areas for long, with rebels swiftly re-emerging, as they have in Homs.

RUSSIAN, CHINESE VETOES

Russia and China have hitherto shielded Assad from Security Council condemnation by vetoing two Western-backed resolutions over the bloodshed, but approved a Security Council statement this week endorsing Annan's mission.

Shifting from its initial unqualified backing of Damascus, Russia has given Annan's proposal its full backing and said it could be Assad's "last chance" to avoid a protracted and bloody civil war.

Russia's only naval base outside the former Soviet Union is on the Mediterranean coast of Moscow's longtime ally, Syria.

Wen told Annan that "the efforts to seek a solution to the Syrian crisis are at a critical juncture. We do believe that your mediation efforts will lead to progress in seeking a solution to the Syrian issue".

Western and Arab leaders are due to meet in Istanbul on April 1 to discuss a political transition and the Arab League and Turkey were pressing various wings of the Syrian opposition gathered in the city to try to unite.

MORE SHOOTING, SHELLING

Opposition activists reported several civilian casualties in shooting late Monday and overnight in the cities of Idlib and Homs, in fighting between government forces and rebels.

Video posted on the internet by activists showed thick black smoke and blazing buildings in a district of Homs. There were wounded and bleeding men and women lying in a street.

In northern Lebanon, residents said Syrian troops pursuing rebels crossed the border and opened fire on farm buildings.

About 300 Syrian opposition representatives from various gathered near Istanbul at the invitation of Turkey and Qatar, which holds the rotating chair of the Arab League.

Burhan Ghalioun, president of the Syrian National Council, wants factions to take a "national oath" pledging a democratic state and national reconciliation once Assad is removed.

A draft declaration said the new Syria will be "civic, democratic and totally free", with a new constitution.

Some leading dissidents recently quit the SNC, dismayed both by Ghalioun's leadership and the influence of the Muslim Brotherhood, which draws support from Syria's Sunni majority.

The opposition has so far rejected Assad's calls for dialogue saying it was too late. The crackdown has angered Arab countries including former allies Qatar and Saudi Arabia, which favour arming the rebels.

SECOND "FRIENDS OF SYRIA" CONFERENCE

Their foreign ministers are due to meet on Sunday in Turkey for a second "Friends of Syria" conference, hoping to persuade Assad to withdraw the army from the cities, let humanitarian aid into the country, and allow a political transition.

Arab leaders will support a Syrian-led transfer of power, Iraq's foreign minister Hoshiyar Zebari said on Monday.

"There has to be a political solution, fundamental constitutional and political changes for transfer of power in Syria but through a Syrian-led process," Zebari said. "We are not in a position to dictate to the Syrians what of kind of president, what kind of leader they should have."

Assad has used the army to crush protests against his 12-year rule but his ruling Alawite Muslim minority and its allies still have substantial popular support in the country.

Annan had said on Monday that Assad's government could not resist the "winds of transformation", but it was too early to introduce any timeline for a peaceful solution.

"It is not practical to put forth timetables and timelines when you haven't got agreement from the parties," he said.

(AP) ? On a dusty, rock-strewn expanse at the edge of the Mojave Desert, a company linked to Senate Majority Leader Harry Reid wants to build a bullet train that would rocket tourists from the middle of nowhere to the gambling palaces of Las Vegas.

Privately held DesertXpress is on the verge of landing a $4.9 billion loan from the Obama administration to build the 150 mph train, which could be a lifeline for a region devastated by the housing crash or a crap shoot for taxpayers weary of Washington spending.

The vast park-and-ride project hinges on the untested idea that car-loving Californians will drive about 100 miles from the Los Angeles area, pull off busy Interstate 15 and board a train for the final leg to the famous Strip.

Planners imagine that millions of travelers a year will one day flock to a station outside down-on-its-luck Victorville, a small city where shuttered storefronts pock the historic downtown.

An alliance of business and political rainmakers from The Strip to Capitol Hill is backing the project that could become the first high-speed system to break ground under President Barack Obama's push to modernize the U.S. rail network ? and give the Democratic president's re-election prospects a lift in battleground Nevada.

Transportation Secretary Ray LaHood has publicly blessed the train ? it means jobs, he says ? and it's cleared several regulatory hurdles in Washington.

Yet even as the Federal Railroad Administration considers awarding what would be, by far, the largest loan of its type, its own research warns it's difficult to predict how many people will ride the train, a critical measure of financial survival, an Associated Press review found.

There are other skeptics, as well.

"It's insanity," says Thomas Finkbiner of the Intermodal Transportation Institute at the University of Denver. "People won't drive to a train to go someplace. If you are going to drive, why not drive all the way and leave when you want?"

Construction cost projections have soared to as much as $6.5 billion, not including interest on the loan. Some fear taxpayer subsidies are inevitable.

Reid and other supporters point to research that shows 80,000 new jobs, but FRA documents show virtually all those would be temporary ? no more than 722 would be permanent.

Victorville Mayor Ryan McEachron envisions a bustling transportation oasis with a hotel, restaurants, maybe even homes, on the proposed station site. He believes drivers can be enticed out of their cars, even in a region where the notion of rail travel can seem as distant as a New York subway.

The company is "going to have to market and market hard in order to get the ridership they need to support paying back the loan," the mayor says. "I think you can change the thinking."

Along with Reid, the president's most influential Democratic ally in Congress, the plan is being advanced by casino developer and contractor Anthony Marnell II, whose credits include building the Bellagio and Wynn Las Vegas and who heads Marnell Companies, the majority shareholder in DesertXpress; project consultant Sig Rogich, a Republican adviser to two presidential campaigns who founded Nevada's most influential lobbying and advertising company; and Canadian transportation giant Bombardier, a DesertXpress strategic adviser that wants to supply its rail cars.

A decision on the loan is not expected until mid-year, but the company has spent some $30 million sharpening its plan and refining ridership projections. Rising gas prices and increasing traffic congestion could help ticket sales, and the company is touting reduced air pollution from fewer cars on the road.

"It's Victorville that makes the project work," says chief executive Andrew Mack.

Far from being a train from nowhere, company planners see the struggling city of 115,000, once a stop on storied Route 66, as a collection point for millions of drivers heading north to Las Vegas. Bringing the line deeper into the populous Los Angeles area would raise formidable challenges, Mack said, from crossing numerous freeways to finding space for track.

The lot now stippled with spindly creosote bushes has room for 15,000 parking spaces. Bags would be checked through to hotel rooms. At peak hours, trains would depart every 20 minutes. Mack says an average round-trip fare could be as low as $75, though documents estimate $100.

Mack says the train will deliver convenience ? and for a price, luxury ? that studies show passengers want.

DesertXpress officials once boasted they would build the line with private dollars, but they now plan to rely on FRA financing to cover the bulk of the cost. Mack didn't directly answer if the company turned to the FRA because private investors were unwilling to take the risk, but said the loan terms are attractive.

"When somebody comes and tells me I will build a system that pays for itself, I'm suspicious," said Hasan Ikhrata, executive director of the Southern California Association of Governments, which questioned ridership potential in a report last year. "There is no high-speed rail system in the world that operates without subsidies."

The company is still arranging as much as $1.6 billion needed to cover its share of the construction bill for the roughly 200-mile line. Investments could hinge on the loan approval, which requires the company to convince the FRA that taxpayers won't get stiffed. In a worst-case scenario, the train would become government property if the company fails.

The low-interest loan would be about three times the combined amount the FRA loaned 32 other projects through the Railroad Rehabilitation & Improvement Financing program since its inception in 2002.

If successful, the train could be a forerunner in a national high-speed rail network, while bringing a rich return for investors and delivering visitors to Vegas. It would also give Nevada residents an option to Southern California, albeit many miles from tourist hotspots like Hollywood or the beaches.

The company is seeking funds at a time when a proposed high-speed train running from San Francisco to Southern California has been questioned because of ballooning costs and fear it will sap taxpayer dollars.

Early company research projected the train would lure away nearly one in four car, bus and airline travelers, initially about 4 million people annually. The company now pegs first-year ridership at about 3 million, but that projection was trimmed to 2.5 million by government analysts who urged more study.

The risks are summarized in a 2007 study commissioned by ACS Infrastructure North America, a division of a global construction company that DesertXpress says is seeking a role in the project, that found most travelers were "broadly happy" going to Las Vegas by car or airline. While most travelers would be open to riding a train, the report warned the company would need to lure riders with pampering.

On clear roads, the 270-mile drive from downtown Los Angeles to Las Vegas takes about four hours. Planners say the train ride from Victorville to Las Vegas would take about 80 minutes, but it's debatable how much time would be saved after parking, boarding the train and reaching a Las Vegas hotel.

Round-trip flights from Los Angeles to Las Vegas can be booked for under $100.

The dream of uniting Southern California and Las Vegas by high-speed rail has been discussed for decades. In the mid-1980s, Las Vegas officials predicted a line would be running by 2000. DesertXpress, which would roughly parallel Interstate-15 on a pair of new tracks, has predicted for several years that it would soon break ground.

Reid initially backed a rival project that planned to use magnetic power to reach Orange County, but he jumped trains shortly after Rogich became co-chair of Republicans for Reid, a Nevada group with ties to the gambling industry that helped Reid win re-election in 2010.

The senator's office disputes any connection between his flip and Rogich's involvement in the campaign. Spokeswoman Kristen Orthman says Reid's decision was based on the viability of DesertXpress, while the magnetically powered project languished.

Marnell, another member of Republicans for Reid, is president of one of several companies under the DesertXpress corporate banner. He and his son, M Resort, Spa and Casino President Anthony Marnell III, are also investors.

Federal records show the elder Marnell has donated at least $15,000 to political committees connected to Reid since 2010, including a $5,000 donation in May to the senator's Searchlight Leadership Fund.

According to federal records, the company has spent at least $270,000 since 2006 lobbying at the House, Senate and federal offices.

Other investors include North Dakota businessman Gary Tharaldson, who donated $10,000 to a Reid committee in March, and transportation expert Tom Stone, who organized DesertXpress with partner Mack in 2005.

Nevada records show DesertXpress HRS Corp., headed by the elder Marnell with his son as a director, was authorized to issue 25,000 shares of stock. DesertXpress declined to say who held those shares, if issued, and in what amounts.

Not everyone in the high desert is on board with the project.

Thirty miles northeast of Victorville on I-15, officials in Barstow fear they'll lose 2,300 jobs. The impact will be "unsustainable," Mayor Joe Gomez wrote to LaHood in October 2010, according to a letter released under a public records request.

To appease those concerns, McEachron said the station's proposed location was moved about halfway to Barstow. The patch of vacant land is so remote the city would have to annex it.
