India gang-rape victim dies in hospital - World News

The 23-year-old who was gang-raped in New Delhi and thrown from a bus has died from her injuries in Singapore, where she was being treated. NBC's Natalie Morales reports.

SINGAPORE ? A 23-year-old Indian woman who was gang-raped and severely beaten on a bus in New Delhi died Saturday at a Singapore hospital.

The woman's horrific ordeal galvanized Indians to demand greater protections against widespread sexual violence, and her death was expected to intensify public demands for action by the Indian government.

The victim who has not been identified,?"passed away peacefully" with her family and officials of the Indian embassy by her side," said Kelvin Loh, the chief executive of Mount Elizabeth Hospital, where she had been treated since Thursday. "The Mount Elizabeth Hospital team of doctors, nurses and staff join her family in mourning her loss," he said in a statement.


The woman and a male friend were traveling in a public bus after watching a film on the evening of Dec. 16 when they were attacked by six men who took turns raping her. They also beat the couple and inserted an iron rod into her body resulting in severe organ damage. Both of them were then stripped and thrown off the bus, according to police.

The woman was airlifted to Singapore on Dec. 26 for specialist treatment, but she had remained in extremely critical condition, Loh said.

The victim had already undergone three abdominal operations before arriving in Singapore, where her condition on Thursday was described as "extremely critical."

"Despite all efforts by a team of eight specialists in Mount Elizabeth Hospital to keep her stable, her condition continued to deteriorate over these two days," said Loh on Saturday. "She had suffered from severe organ failure following serious injuries to her body and brain. She was courageous in fighting for her life for so long against the odds but the trauma to her body was too severe for her to overcome."

The attack triggered nationwide protest?over the lack of safety for women, culminating last weekend in pitched battles between police and protesters in the heart of the capital.

New Delhi has the highest number of sex crimes among India's major cities, with a rape reported on average every 18 hours, according to police figures. Government data show the number of reported rape cases in the country rose by nearly 17 percent between 2007 and 2011.

Prime Minister Manmohan Singh's government seemed at first caught off guard by the reaction to the attack, which sparked a blame game between politicians and the police.

On Saturday he said that he was aware of the emotions the attack has stirred and that it was up to all Indians to ensure that the young woman's death will not have been in vain.

"These are perfectly understandable reactions from a young India and an India that genuinely desires change," Singh said in a statement. "It would be a true homage to her memory if we are able to channel these emotions and energies into a constructive course of action."

He said the government was examining the penalties for crimes such as rape "to enhance the safety and security of women."

Indian television channels said security had been tightened in New Delhi on Saturday in anticipation of more protests following the woman's death.

(AP) ? With a proposed payout of more than $1 billion, one major chapter of a nearly four-year legal saga that left Toyota Motor Corp. fighting hundreds of lawsuits and struggling with a tarnished image has ended, though another remains.

The settlement ? unprecedented in its size according to a plaintiff's attorney ? brings an end to claims from owners who said the value of their vehicles plunged after recalls over sudden and unintended acceleration.

Lawsuits claiming that the defects caused injury or death remain, with the first trial beginning in February unless another major deal comes first.

Steve Berman, a lawyer representing Toyota owners, said the settlement is the largest in U.S. history involving automobile defects.

"We kept fighting and fighting and we secured what we think was a good settlement given the risks of this litigation," Berman told The Associated Press.

The courtroom claims began with a highway tragedy. A California Highway Patrol officer and three of his family members were killed in suburban San Diego in 2009 after their car, a Toyota-built Lexus, reached speeds of more than 120 mph, hit an SUV, launched off an embankment, rolled several times and burst into flames.

Investigators determined that a wrong-size floor mat trapped the accelerator and caused the crash.

That discovery, and the accident's grisliness, spurred a series of recalls involving more than 14 million vehicles and a flood of lawsuits soon followed, with numerous complaints of accelerations in several models, and brake defects with the Prius hybrid.

The Japanese automaker has blamed driver error, faulty floor mats and stuck accelerator pedals for the problems.

The runaway Lexus case was settled separately for $10 million in 2010, before the cases were consolidated by U.S. District Judge James Selna.

Selna divided them into two categories: economic loss and wrongful death. He needs to approve Wednesday's settlement, which only applies to the first group of lawsuits. The deal was filed Wednesday and Selna is expected to review it on Friday.

Toyota said it will take a one-time, $1.1 billion pre-tax charge against earnings to cover the estimated costs of the settlement. Berman said the total value of the deal is between $1.2 billion and $1.4 billion.

As part of the economic loss settlement, Toyota will offer cash payments from a pool of about $250 million to eligible customers who sold vehicles or turned in leased vehicles between September 2009 and December 2010.

The company also will launch a $250 million program for 16 million current owners to provide supplemental warranty coverage for certain vehicle components, and it will retrofit about 3.2 million vehicles with a brake override system. An override system is designed to ensure a car will stop when the brakes are applied, even if the accelerator pedal is depressed.

The settlement would also establish additional driver education programs and fund new research into advanced safety technologies.

"In keeping with our core principles, we have structured this agreement in ways that work to put our customers first and demonstrate that they can count on Toyota to stand behind our vehicles," said Christopher Reynolds, Toyota vice president and general counsel.

Current and former Toyota owners are expected to receive more information about the settlement in the coming months.

Plaintiffs' attorneys have spent the past two years deposing Toyota employees, poring over thousands of documents and reviewing software code, but the company maintains those lawyers have been unable to prove that a design defect ? namely Toyota's electronic throttle control system ? was responsible for vehicles surging unexpectedly.

Both the National Highway Traffic Safety Administration and NASA were unable to find any defects in Toyota's source code that could cause problems.

The company has been dogged by fines for not reporting problems in a timely manner.

Earlier this month, NHTSA doled out a record $17.4 million fine to Toyota for failing to quickly report floor mat problems with some of its Lexus models. Toyota paid a total of $48.8 million in fines for three violations in 2010.

Toyota President Akio Toyoda appeared before Congress last year and pledged to strengthen quality control. Recent sales figures show the company appears to have rebounded following its safety issues.

The Center for Science in the Public Interest has taken an interest in her commercial endorsement activities, and asked her to un-sign a $50-million deal with PepsiCo, the makers of sugar-sweetened beverages sold all over the world, and responsible for who knows how much obesity and diabetes. Beyonc? agreed to advertise their products for another 10 years, including during the halftime show for next year?s SuperBowl. Executive director Michael F. Jacobson wrote the singing star a letter saying:

You occupy a unique position in the cultural life of this country and are an inspiring role model for millions of young people. By lending your name and image to PepsiCo, you are associating your positive attributes with a product that is quite literally sickening Americans.

This is the same group, Bloomberg journalist Duane D. Stanford reminds us, whose 1998 report titled ?Liquid Candy: How Soft Drinks Are Harming America?s Health? helped to influence legislation in some places. They are even trying to shame the musical performer by bringing in race. Stanford explains:

Obesity-related health problems have a disproportionate impact on low-income, African-American and Hispanic communities, Jacobson said, asking Beyonce to reconsider the Pepsi-Cola deal or donate the proceeds to health causes.

Tigers roar back: Great news for big cats in key areas

Dec. 26, 2012 ? The Wildlife Conservation Society (WCS) has announced significant progress for tigers in three key landscapes across the big cat's range due to better law enforcement, protection of additional habitat, and strong government partnerships.

The successes are much-needed good news as tiger numbers worldwide continue to hover at all-time lows due to the combined threat of poaching, loss of prey, and habitat destruction. WCS estimates that only 3,200 tigers exist in the wild.

The news begins in southwestern India where WCS research and conservation efforts that began 25 years ago now show a major rebound of tigers in the Western Ghats region of Karnataka State. Over 600 individuals have been identified to date from camera trap photos during the last decade in this mountainous landscape. In Nagarahole and Bandipur National Parks, tigers have actually reached saturation levels, with surplus young tigers spilling out into forest-reserves and dispersing using secured forest corridors through a landscape that holds over a million human beings. The combination of strict government-led anti-poaching patrols, voluntary relocation of villages away from tiger habitats, and the vigilant local presence of WCS conservation partners watching over tigers has led to the rebound of big-cat populations and their prey. In newer tiger reserves including Bhadra and Kudremukh, numbers have increased by as much as 50 percent after years of neglect and chronic poaching were tackled.

In Thailand, WCS conservationists report a tiger comeback in Huai Kha Khaeng (HKK) Wildlife Sanctuary -- a 2,700 square kilometer (1,042 square mile) protected area in the vast Western Forest Complex. WCS has worked closely with Thai authorities to beef up enforcement and anti-poaching patrols in the region. Last year, a notorious poaching ring was busted, and this year the gang leaders were given prison sentences of up to five years -- the most severe punishments for wildlife poaching in Thailand's history. Since their capture, there have been no known tiger or elephant poaching incidents in the park. Tiger numbers have been rising steadily in the park since 2007, with a record 50-plus tigers counted last year.

Meanwhile in Russia, government officials are drafting a new law that will make transport, sales, and possession of endangered animals a criminal offense rather than just a civil crime. This will close a loophole that currently allows poachers to claim they found endangered species like tigers already dead and thus avoid stiffer criminal penalties for poaching.

Russia is making progress in creating additional protected areas for tigers, too, declaring a new corridor called Central Ussuri Wildlife Refuge on October 18. The new refuge acts as a linkage between the Sikhote-Alin tiger population in Russia, which is the main population of Amur tigers, and some of the best tiger habitat in China's Heilongjiang Province in the Wandashan Mountains. The creation of the new refuge ensures that tigers have the capacity to move across the international border between Russian and China in this region. WCS first identified this key corridor in 1999 after conducting joint wildlife surveys with Chinese and Russian scientists there. WCS President and CEO Cristi?n Samper said: "Tigers are clearly fighting for their very existence, but it's important to know that there is hope. Victories like these give us the resolve to continue to battle for these magnificent big cats. While the news about tigers has been bleak, these recent developments clearly show how smart strategies and strong partnerships are ensuring tigers are saved for centuries to come."

Americans may be evacuated from African capital

Hundreds protest in front of the French Embassy in the Bangui, Central African Republic, on Wednesday, expressing anger over the lack of response by the former colonial power to rebels advancing on the capital.

The United States military was preparing Thursday for a possible evacuation of American citizens from the Central African Republic as?rebel forces?advanced on the capital, Bangui, a senior defense official told NBC News.

Insurgents on motorbikes and in pickup trucks have driven to within 45 miles of Bangui after weeks of fighting, threatening to end President Francois Bozize's nearly 10-year rule over the turbulent, resource-rich country.

Bozize appealed to the United States and France to help push back the rebels.


Some U.S. Special Forces are operating in the country, trying to track down the Lords Resistance Army, a rebel group responsible for killing thousands of civilians across four African nations.?There was no indication that these forces would be used to aid Bozize against the advancing insurgents.

There are?"several hundred" civilians, including Americans and citizens from close U.S. allies in the Central African Republic who may be moved out of harm's way, the defense official said, but the State Department had not yet made the final call for evacuation.

Paris said its troops were only ready to protect French nationals.

Some 1,200 French nationals live in the CAR, mostly in the capital, according to the French Foreign Ministry, where they typically work for mining firms or aid groups.

The contingency plans were emerging as regional African leaders tried to broker a ceasefire deal and as rebels said they had temporarily halted their advance on Bangui to allow talks to take place.

The rebel advance has highlighted the instability of a country that has remained poor since independence from Paris in 1960 despite rich deposits of uranium, gold and diamonds. Average income is barely over $2 a day.

French nuclear energy group Areva mines the Bakouma uranium deposit in the CAR's south ? France's biggest commercial interest in its former colony.?

Bozize on Thursday appealed for French and U.S. military support to stop the SELEKA rebel coalition, which has promised to overthrow him unless he implements a previous peace deal in full.

France: 'Those days are over'
He told a crowd of anti-rebel protesters in the riverside capital that he had asked Paris and Washington to help move the rebels away from the capital to clear the way for peace talks which regional leaders say could be held soon in Libreville, Gabon.

"We are asking our cousins the French and the United States, which are major powers, to help us push back the rebels to their initial positions in a way that will permit talks in Libreville to resolve this crisis," Bozize said.

France has 250 soldiers in its landlocked former colony as part of a peacekeeping mission and Paris in the past has ousted or propped up governments ? including by using air strikes to defend Bozize against rebels in 2006.

But French President Francois Hollande poured cold water on the latest request for help.

"If we have a presence, it's not to protect a regime, it's to protect our nationals and our interests and in no way to intervene in the internal business of a country, in this case the Central African Republic," Hollande said on the sidelines of a visit to a wholesale food market outside Paris.

"Those days are over," he said.

Officials from around central Africa were to meet in Bangui later on Thursday to open initial talks with the government and rebels.

A rebel spokesman said fighters had temporarily halted their advance to allow dialogue.

"We will not enter Bangui," Col. Djouma Narkoyo, the rebel spokesman, told Reuters by telephone.

Previous rebel promises to stop advancing have been broken, and a diplomatic source said rebels had taken up positions around Bangui on Thursday, effectively surrounding it.

The atmosphere remained tense in Bangui the day after anti-rebel protests broke out, and residents were stocking up on food and water.

Government soldiers deployed at strategic sites and French troops reinforced security at the French embassy after protesters threw rocks at the building on Wednesday.

Bozize came to power in a 2003 rebellion that overthrew President Ange-Felix Patasse.

However, France is increasingly reluctant to directly intervene in conflicts in its former colonies. Since coming to power in May, Hollande has promised to end its shadowy relations with former colonies and put ties on a healthier footing.

A military source and an aid worker said the rebels had got as far as Damara, 47 miles from Bangui, by late afternoon on Wednesday, having skirted Sibut, where some 150 Chadian soldiers had earlier been deployed to try and block a push south by a rebel coalition.

With a government that holds little sway outside the capital, some parts of the country have long endured the consequences of conflicts in troubled neighbors Chad, Sudan and the Democratic Republic of Congo spilling over.

Family: Boy's favorite teacher died cradling him

As families struggle to pick up the pieces of their shattered lives in the wake of the mass shooting in Newtown, Conn., some are clinging to bits of solace from the grim details that emerge.

The family of six-year-old Dylan Hockley, one of the 20 children killed in the shootings last Friday, revealed in a statement Monday that their child's favorite teacher at Sandy Hook Elementary cradled him as they both?died in a hail of bullets.?

"We take great comfort in knowing that Dylan was not alone when he died but was wrapped in the arms of his amazing aide, Anne Marie Murphy," Dylan?s family said in a statement. "Dylan loved Mrs. Murphy so much and pointed at her picture on our refrigerator every day."

Murphy, 52, a mother to four children with her husband, Michael, was a special education teacher in Dylan?s classroom at Sandy Hook.?She was a?14-year resident of Sandy Hook and formerly of Katonah, N.Y., according to her obituary.

"She will be remembered for her love of the arts, walks in the outdoors and most importantly: her family," her obituary said.

Authorities reportedly told Murphy's parents, Hugh and Alice McGowan, that their daughter helped shield some of her students from the rain of bullets.

?A first responder said she was a hero,? her 86-year-old father told Newsday. ?You don?t expect your daughter to be murdered. That?s sort of a shocker.?

Murphy?s mother, also 86, said she grabbed her rosary and cried when she got the news.?

Dylan?s parents, Ian Thomas, who is British, and Nicole Marie (Moretti), both 42, had lived in England for 18 years before moving to a house on the same street as Nancy Lanza, the gunman's mother and first victim,?in January, The Telegraph (U.K.) reported. They said they chose Newtown specifically for the?tight-knit?community and the Sandy Hook school.

?We do not and shall never regret this choice,? they said. ?Our boys have flourished here and our family?s happiness has been limitless.??

The family also praised other staffers and teachers who died at Sandy Hook.

"We cannot speak highly enough of Dawn Hochsprung and Mary Sherlach, exceptional women who knew both our children and who specifically helped us navigate Dylan's special education needs," Dylan's family added.?"Dylan's teacher, Vicki Soto, was warm and funny and Dylan loved her dearly."

Both Hochsprung, 47, the school principal, and Sherlach, 56, the school psychologist, died while lunging at the gunman, 20-year-old Adam Lanza, in an attempt to overpower him. Soto, 27, a first-grade teacher,?shielded her students and ushered them into a closet, putting herself between them and the gunman. She was found huddled with the children.?

"Though our hearts break for Dylan, they are also filled with love for these and other beautiful women who all selflessly died trying to save our children," the family said.

In the statement, the Hockley family said Dylan loved to cuddle, bounce on his trampoline and play computer games. He also looked up to his older brother, Jake.?He was learning to read and "was so proud when he read us a new book every day."?

"We will always be a family of four," they said. "He is forever in our hearts and minds."?

Pocket test measures fifty things in a drop of blood

A new device about the size of a business card could allow health care providers to test for insulin and other blood proteins, cholesterol, and even signs of viral or bacterial infection all at the same time -- with one drop of blood. Preliminary tests of the V-chip, created by scientists at The Methodist Hospital Research Institute and MD Anderson Cancer Center, were just published by Nature Communications.

"The V-Chip could make it possible to bring tests to the bedside, remote areas, and other types of point-of-care needs," said Nanomedicine faculty member Lidong Qin, Ph.D., the project's principal investigator. "V-Chip is accurate, cheap, and portable. It requires only a drop of a sample, not a vial of blood, and can do 50 different tests in one go."

Similar assays are typically done using heavy, large, complex equipment such as mass spectrometers, or require fluoroscopy analysis, which must also be done in a lab.

The V-chip, short for "volumetric bar-chart chip," on the other hand, can be carried around in a pocket. It is composed of two thin pieces of glass, about 3 in. by 2 in. In between are wells for four things: (1) hydrogen peroxide, (2) up to 50 different antibodies to specific proteins, DNA or RNA fragments, or lipids of interest, and the enzyme catalase, (3) serum or other sample, and (4) a dye -- any dye will do. Initially, the wells are kept separate from each other. A shift in the glass plates brings the wells into contact, creating a contiguous, zig-zagged space from one end of the V-chip to the other.

As the substance of interest -- say, insulin -- binds to antibodies bound to the glass slide, catalase is made active and splits nearby hydrogen peroxide into water and oxygen gas. This approach is called ELISA, or enzyme-linked immunosorbent assay. The oxygen pushes the dye up the column. The more present insulin is, the more oxygen is created, and the farther dye is pushed up the slide. Tests show that distance is more or less proportional to the amount of substrate present, in this example, insulin. The end result is a visual bar chart. Easy to read and accurate, Qin says, though development continues.

"The sensitivity of the V-chip can be improved if narrower and longer bar channels are used," Qin said. "Our next steps are to make the device more user friendly and be so simple to use, it barely needs instructions."

Qin is also a Weill Cornell Medical College assistant professor of cell and developmental biology.

Clearwire, Sprint set $120 million breakup fee

(Reuters) - Sprint Corp promised to pay Clearwire Corp a $120 million breakup fee if its $2.2 billion purchase of roughly half of the smaller wireless service provider does not go ahead but it restricted Clearwire's ability to entertain other offers.

Sprint, the majority owner of Clearwire, announced details of its purchase agreement in a regulatory filing on Tuesday, the day after it said it would buy out the rest of Clearwire for $2.97 per share.

Clearwire shares were below the offer price at $2.88 in morning trade.

Some shareholders said they were disappointed by the price, which requires approval from a majority of Clearwire's minority shareholders. While one shareholder is looking for support for a class action lawsuit against the deal, another is still holding out hope for a higher bid.

But Sprint said in the filing that Clearwire had agreed to a no-shop restriction of its ability to solicit other offers.

It also said that Clearwire would be restricted from providing information to or engaging in discussions or negotiations with third parties regarding an acquisition proposal, subject to certain exceptions.

It did not disclose the potential exceptions to the rule.

The Clearwire deal is conditional on the sale of a 70 percent stake in Sprint to Japan's SoftBank Corp for $20 billion, which is expected to close around mid-2013.

Sprint would have to pay the breakup fee if the SoftBank deal does not happen, if it or Clearwire terminates the agreement, or if their deal has not been consummated on or before October 15, 2013, according to the filing.

The merger agreement also includes a "no-shop" restriction on Clearwire's ability to solicit acquisition proposals.

Sprint has support for the deal from at least three Clearwire shareholders owning 13 percent of the company - Intel Corp, Comcast Corp and cable company Bright House.

Clearwire shares were down 3 cents or 1 percent at $2.88 in morning trade on Nasdaq. Sprint stock was down 8 cents or 1.4 percent at $5.48 on New York Stock Exchange.

Medical errors in hospitals: Doing the right thing when things go wrong

Dec. 14, 2012 ? The University of Michigan Health System doesn't claim to be perfect. But its response to medical errors, near-misses, unexpected clinical problems and unintended outcomes is a model for the nation that other hospitals can and should copy, according to a new paper in a health care journal.

The "Michigan Model" for handling these situations, and preventing them from happening again, has not only helped patients and medical staff alike -- it has also helped UMHS go against the grain of the costly, combative "deny and defend" medical malpractice culture.

In a paper in December issue of the Milbank Quarterly, and in a presentation December 14 at a meeting of the U-M Board of Regents, the UMHS approach is once again in the spotlight for its potential to be emulated by hospitals across the country.

The new paper, authored mainly by Massachusetts-based researchers, lays out the fundamentals of the model for other hospitals to emulate. The authors, from Harvard Medical School and the Massachusetts Medical Society, report that key stakeholders across the medical and legal community see the Michigan approach as a feasible and promising approach for their state.

The presentation to the U-M Regents, given by UMHS chief medical officer Darrell A. Campbell, Jr, M.D. and executive director of clinical safety Rick Boothman, J.D., lays out further the details and results of the UMHS approach. They also featured video clips from actual patients and patient family members, who have told their unvarnished stories for a video aimed at every member of the UMHS care team.

"By handling unanticipated and unintended incidents, and patient injuries, honestly and proactively, we've virtually eliminated groundless legal claims, allowing us to focus on issues that demand attention with clear vision and no more excuses," says Boothman. "We fundamentally focus on putting patients and safety first, and we believe other hospitals can do the same."

Campbell and Boothman have led a decade-long effort to implement and measure the results of the Michigan Model. It's based on these key principles:

? Compensate patients quickly and fairly when inappropriate care causes injury

? Support clinical staff when the care was reasonable

? Reduce patient injuries (and claims) by learning from patients' experiences

In that decade, new malpractice claims per month have dropped, total liability costs have dropped, claims and potential claims are being resolved faster, and UMHS is increasingly avoiding litigation in both claims without merit and claims with merit.

The authors of the new paper, who interviewed 37 physicians, hospital executives, attorneys, public policymakers, insurers and others across Massachusetts, find a general consensus that the Michigan approach -- also called DA&O for "disclose, apologize and offer" -- holds great potential to improve medical liability and patient safety.

They write: "It was viewed as more promising than any other liability reform option, both on its merits and because it would not be stymied by political gridlock in state legislatures, as other tort reforms frequently have been." They also note that it offers a "value proposition" to patients that's crucial in this age of federal health care reform.

The authors also note that their interviews indicate that experts across the board do see challenges in implementing the Michigan Model in other hospitals and health care settings.

But, they conclude, based on the evidence available, "DA&O programs may prove not only to constrain liability costs but also to improve access to compensation, strengthen linkages between the liability system and patient safety, increase health care organizations' accountability and patient advocacy, and promote transparency in regard to medical error."

Boothman, who is a co-author of the new paper, notes that the Michigan Model or DA&O has also been put forth as a model by the federal Agency for Health Care Research and Quality, which has issued grants for teams to study implementation of the Michigan Model as the leading response to the malpractice crisis. There have also been legislative and research efforts in Massachusetts, Washington, New York, Illinois, Oregon and Florida based in part on the DA&O approach, and interest from four other countries.

SKorea says Samsung chip plant caused cancer

(AP) ? A South Korean government agency said Friday that working at a Samsung Electronics factory caused the breast cancer of a worker who died earlier this year, only the second time it has recognized a link between cancer and Samsung's chip plants.

The Korea Workers' Compensation and Welfare Service, which is part of the labor ministry, ruled earlier this month that there was a "considerable causal relationship" between the woman's cancer and her five years of work at a semiconductor plant near Seoul. The ruling didn't become public until Friday when the agency announced compensation for the woman's family.

Samsung spokesman James Chung said it will not appeal the government's decision. The company is the world's largest maker of computer memory chips.

There have been very few cases in South Korea in which a link between working conditions and cancer has been convincingly demonstrated. Nearly 30 South Koreans have filed claims with the agency that working at Samsung caused rare forms of disease, cancer, multiple sclerosis and brain tumors. Another dozen people whose claims were rejected by the agency have filed court appeals.

The Korea Workers' Compensation and Welfare Service collects insurance fees from companies and makes rulings on whether diseases are caused by workplace hazards. Workers file industrial disease-related claims with the agency, not with their employer. Either party can appeal to the courts.

The woman, whose last name is Kim, died in March, age 36, three years after being diagnosed with breast cancer. Kim worked for Samsung from 1995 to 2000. Her first name was not released at her family's request.

The agency didn't say how much compensation was paid, but spokesman Kang Byung-soo said it usually amounts to nearly four years of a worker's salary.

"There was an exposure to organic solvents and radiation. The earlier the exposure is, the more likely the cancer is caused," the workers compensation agency said in a statement about Kim's case.

It said it also reviewed records from overseas which showed that working night shifts is linked to a higher chance of breast cancer.

Kim, who worked eight to 12 hours a day, was often assigned night time shifts that started at 10 p.m. and ended at 6 in the morning, according to Lee Jong-ran, an official at SHAPRs, or Supporters for the Health And Rights of People in the Semiconductor industry.

Kim worked at a plant without a radiation detector and was exposed to benzene and other carcinogens, according to the activist group.

Lee said the latest decision will have a positive impact on Samsung employees who are hoping to prove a link between their diseases and working conditions at Samsung Electronics.

"Because the government recognized the link, people who have pending lawsuits will feel encouraged," she said.

There have been three recent cases in which authorities recognized that working conditions at Samsung had contributed to diseases.

In April, the agency compensated a former Samsung worker who suffered from aplastic anemia. Last year, a Seoul court ruled that a Samsung semiconductor plant caused the cancer of two former employees. The agency, which had earlier rejected claims from the two workers, is appealing the court's decision.

Bayer seeks FDA approval for cancer drug radium-223

FRANKFURT (Reuters) - German drugmaker Bayer said on Friday it requested approval from U.S. regulators for an experimental prostate cancer drug that could eventually generate more than 1 billion euros ($1.31 billion) in annual sales.

Radium-223 dichloride, which Bayer used to call Alpharadin, is designed to target bone metastases from prostate cancer that cannot be treated by standard hormone therapy.

Bayer licensed radium-223 from Algeta in 2009, and if approved in the United States, radium-223 will be co-promoted by Bayer and Algeta, the Oslo-based company said on Friday.

Bayer, which on Wednesday said it was requesting EU approval for the drug, will market radium-223 alone in Europe if the treatment is approved there.

Bayer said last year that Radium-223 dichloride could become a "blockbuster" product with annual sales of least 1 billion euros.

The drug has some properties of calcium, which makes it cling to cancerous bone cells and then destroy them via alpha rays, which is more targeted that the shotgun approach of conventional radiotherapy.

Chevron to pay $1.8 million in Utah settlement

SALT LAKE CITY (AP) -- Chevron Corp. has paid Utah $1.8 million in a settlement reached after Utah claimed the oil company collected money from a cleanup fund meant only for firms without insurance, state officials said Thursday.

Chevron misrepresented the fact that it had coverage when it applied for reimbursement from the fund established for the cleanup of leaky underground storage tanks, the Utah attorney general's office said.

The state said Chevron should have repaid the money it received along with paying penalties, fines, interest and attorney fees.

Chevron denied the allegations and said in the settlement it was legally entitled to money from the fund. Company spokesman Brent Tippen said Chevron was pleased to reach a mutually acceptable settlement.

"Chevron acted at all times in good faith and believes its dealings with the state's underground storage tank fund have been proper and without fault," Tippen said in a statement to The Associated Press. "It is advantageous for both sides, however, to bring this matter to a conclusion."

It was the first negotiated settlement reached between Utah and oil companies accused of misusing the fund.

The state sued ConocoPhillips and BP Amoco after those companies refused to negotiate a settlement, said Donna Kemp Spangler, spokeswoman for Utah's Division of Environmental Quality.

The state says BP Amoco helped itself for a dozen years to state assistance, collecting $1.5 million until 2007. The state claims ConocoPhillips filed $25 million in false claims over 14 years.

Montana is also pursuing a claim that BP collected money from a tank cleanup fund while receiving payouts from an insurance company.

BP says the lawsuits are without merit. ConocoPhillips has said it does not comment on legal issues.

Settlements are still possible with those two companies, but the two sides are not close at this time, said Therron Blatter of Utah's Division of Environmental Quality.

Utah's Petroleum Storage Tank Fund was created by the Legislature in 1989 to help small gas station owners who paid into the account get help when they had leaky storage tanks, Kemp Spangler said.

"We need to have that fund whole," Kemp Spangler said. "We need to make sure there is enough money to pay the people that are participating in it."

The presence of Cladophora in the Great Lakes, including phosphorus-rich Lake Erie, is an age-old problem that has found its way back onto the radar of scientists, including Mercyhurst University biologist Steven Mauro, Ph.D.

Reports of beach fouling, concerns that incidences of avian botulism are linked to Cladophora and scientific studies linking Cladophora and human pathogens have sparked renewed attention in the nuisance algae.

For Mauro, whose research in recent years has focused on potential human pathogens in the recreational waters of Lake Erie at Presque Isle State Park, a new grant will enable him to look more closely at Cladophora. Mauro is the recipient of a $21,000 award from Pennsylvania Sea Grant to study the role temperature and phosphorus have on the survival of bacteria on algae in the Great Lakes.

"Accumulation of algae in lakes and oceans can be problematic because of its ability to harbor bacteria," Mauro said. "Specifically, algal mats of Cladophora in the Great Lakes harbor very high concentrations of bacteria, some of which are pathogenic to humans."

The growth of Cladophora is intimately linked to temperature conditions and the availability of phosphorus and, yet, Mauro said scientists know very little about how these same factors influence bacterial abundance and growth on Cladophora, information that is vital to assessing those factors that make the presence of Cladophora harmful to humans.

Mercyhurst researchers will test how temperature and phosphorus concentrations impact bacterial concentration on Cladophora under controlled laboratory conditions, findings that will be directly examined in Presque Isle beach waters in summer 2013.

"Together, this information will lead to a better understanding of how global warming and persistent phosphorus loading into waters contribute to the accumulation of bacterial pathogens in recreational waters," he said.

Since 2006, Mauro and his team of student researchers have developed protocols to reduce bacterial sampling time, produced scientific evidence linking human waste from creeks to beach water contamination and established the first long-term human bacterial pathogen-specific study at Presque Isle.
