Music lovers and enthusiasts have all the rights to learn their chosen musical instrument despite of their impairment, as long as such will not completely forbid them to play such. Obama Backs Off Social Security, Medicare Reform (The Nation)

The Nation -- The word is out in Washington.? When the president announces his deficit-reduction proposals next week, he will definitely not suggest?any hit?on Social Security nor any increase in?the eligibility age for Medicare.? That's a?small victory for reason and social equity.?We can thank the voters of Brooklyn's?Ninth Congressional District who?this week elected a Republican representative for the first time in nearly 90 years.?

The White House spin claims this off defeat?has nothing to do with?Barack Obama, but that's tripe.? Working politicians?know better.? The Brooklyn special election was an ominous rebuke to the president, suggesting he may be?heading?into?Jimmy Carter territory.? Despite?official denials, Obama?may be getting?the message.?At least the White House leakers were busy spreading the word to major media?that Obama has?dropped any intention of?of whacking Social Security or Medicare eligibility in order to entice Republicans into some sort of?grand compromise.

Congressional Democrats have felt?a stabbing pain in the back whenever the president talked about "entitlement reform."??The Dems?hope to run against the Republicans next year on those very issues?defending the great liberal social programs?against?cut-throat Republicans. Obama was threatening?to throw away their best cards.? They don't have many others, given the?stalled?economy, flirting with recession.?The president's new job-creating plan is?thin gruel.? Even if Republicans allowed the legislation to pass (which they won't), it won't do?much to stop the bleeding.?? Most Democrats pretend to be thrilled anyway. Privately, they have?a scary, sinking feeling.

Life is unfair, so is politics. What happened to Jimmy Carter in the spring of 1980 was that fellow many Democrats concluded his presidency was doomed?and so they concentrated on?personal survival.? Many ran campaigns that emphasized their own accomplishments and never mentioned his name.?Others?actively ran against their own incumbent president (with?limited results).??Carter's people kept saying, not to worry?the people will never elect a right-wing kook like Ronald Reagan as their president.? The rest is history, as they say.

Obama is not?helpless.? He could change the game again and more dramatically by?employing the presidency?s vast discretion to launch new government policies?on his own, while running hard against the "party of no.? It's true neither Obama nor his advisors are inclined toward aggressive unilateral action and?they are fast running out of time.?But other Democrats should keep?banging on him, less politely and more publically?than they have so far.???Brooklyn's Ninth?District might be his?ast wake-up call.

ENROLLED SENATE BILL No. 228

AN ACT to amend 1975 PA 238, entitled ?An act to require the reporting of child abuse and neglect by certain persons; to permit the reporting of child abuse and neglect by all persons; to provide for the protection of children who are abused or neglected; to authorize limited detainment in protective custody; to authorize medical examinations; to prescribe the powers and duties of the state department of social services to prevent child abuse and neglect; to prescribe certain powers and duties of local law enforcement agencies; to safeguard and enhance the welfare of children and preserve family life; to provide for the appointment of legal counsel; to provide for the abrogation of privileged communications; to provide civil and criminal immunity for certain persons; to provide rules of evidence in certain cases; to provide for confidentiality of records; to provide for the expungement of certain records; to prescribe penalties; and to repeal certain acts and parts of acts,? by amending section 7 (MCL 722.627), as amended by 2008 PA 300.

The People of the State of Michigan enact:

Sec. 7. (1) The department shall maintain a statewide, electronic central registry to carry out the intent of this act.

(2) Unless made public as specified information released under section 7d, a written report, document, or photograph filed with the department as provided in this act is a confidential record available only to 1 or more of the following:

(a) A legally mandated public or private child protective agency investigating a report of known or suspected child abuse or neglect or a legally mandated public or private child protective agency or foster care agency prosecuting a disciplinary action against its own employee involving child protective services or foster records.

(b) A police or other law enforcement agency investigating a report of known or suspected child abuse or neglect.

(c) A physician who is treating a child whom the physician reasonably suspects may be abused or neglected.

(d) A person legally authorized to place a child in protective custody when the person is confronted with a child whom the person reasonably suspects may be abused or neglected and the confidential record is necessary to determine whether to place the child in protective custody.

(e) A person, agency, or organization, including a multidisciplinary case consultation team, authorized to diagnose, care for, treat, or supervise a child or family who is the subject of a report or record under this act, or who is responsible for the child?s health or welfare.

(f) A person named in the report or record as a perpetrator or alleged perpetrator of the child abuse or neglect or a victim who is an adult at the time of the request, if the identity of the reporting person is protected as provided in section 5.

(g) A court that determines the information is necessary to decide an issue before the court. In the event of a child?s death, a court that had jurisdiction over that child under section 2(b) of chapter XIIA of the probate code of 1939, 1939 PA 288, MCL 712A.2.

(h) A grand jury that determines the information is necessary to conduct the grand jury?s official business.

(i) A person, agency, or organization engaged in a bona fide research or evaluation project. The person, agency, or organization shall not release information identifying a person named in the report or record unless that person?s written consent is obtained. The person, agency, or organization shall not conduct a personal interview with a family without the family?s prior consent and shall not disclose information that would identify the child or the child?s family or other identifying information. The department director may authorize the release of information to a person, agency, or organization described in this subdivision if the release contributes to the purposes of this act and the person, agency, or organization has appropriate controls to maintain the confidentiality of personally identifying information for a person named in a report or record made under this act.

(j) A lawyer-guardian ad litem or other attorney appointed as provided by section 10.

(k) A child placing agency licensed under 1973 PA 116, MCL 722.111 to 722.128, for the purpose of investigating an applicant for adoption, a foster care applicant or licensee or an employee of a foster care applicant or licensee, an adult member of an applicant?s or licensee?s household, or other persons in a foster care or adoptive home who are directly responsible for the care and welfare of children, to determine suitability of a home for adoption or foster care. The child placing agency shall disclose the information to a foster care applicant or licensee under 1973 PA 116, MCL 722.111 to 722.128, or to an applicant for adoption.

(l) Family division of circuit court staff authorized by the court to investigate foster care applicants and licensees, employees of foster care applicants and licensees, adult members of the applicant?s or licensee?s household, and other persons in the home who are directly responsible for the care and welfare of children, for the purpose of determining the suitability of the home for foster care. The court shall disclose this information to the applicant or licensee.

(m) Subject to section 7a, a standing or select committee or appropriations subcommittee of either house of the legislature having jurisdiction over child protective services matters.

(n) The children?s ombudsman appointed under the children?s ombudsman act, 1994 PA 204, MCL 722.921 to 722.932.

(o) A child fatality review team established under section 7b and authorized under that section to investigate and review a child death.

(p) A county medical examiner or deputy county medical examiner appointed under 1953 PA 181, MCL 52.201 to 52.216, for the purpose of carrying out his or her duties under that act.

(q) A citizen review panel established by the department. Access under this subdivision is limited to information the department determines is necessary for the panel to carry out its prescribed duties.

(r) A child care regulatory agency.

(s) A foster care review board for the purpose of meeting the requirements of 1984 PA 422, MCL 722.131 to 722.139a.

(t) A local friend of the court office.

(3) Subject to subsection (9), a person or entity to whom information described in subsection (2) is disclosed shall make the information available only to a person or entity described in subsection (2). This subsection does not require a court proceeding to be closed that otherwise would be open to the public.

(4) If the department classifies a report of suspected child abuse or neglect as a central registry case, the department shall maintain a record in the central registry and, within 30 days after the classification, shall notify in writing each person who is named in the record as a perpetrator of the child abuse or neglect. The notice shall set forth the person?s right to request expunction of the record and the right to a hearing if the department refuses the request. The notice shall state that the record may be released under section 7d. The notice shall not identify the person reporting the suspected child abuse or neglect.

(5) A person who is the subject of a report or record made under this act may request the department to amend an inaccurate report or record from the central registry and local office file. A person who is the subject of a report or record made under this act may request the department to expunge from the central registry a report or record in which no relevant and accurate evidence of abuse or neglect is found to exist. A report or record filed in a local office file is not subject to expunction except as the department authorizes, if considered in the best interest of the child.

(6) If the department refuses a request for amendment or expunction under subsection (5), or fails to act within 30 days after receiving the request, the department shall hold a hearing to determine by a preponderance of the evidence whether the report or record in whole or in part should be amended or expunged from the central registry on the grounds that the report or record is not relevant or accurate evidence of abuse or neglect. The hearing shall be held before a hearing officer appointed by the department and shall be conducted as prescribed by the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.

(7) If the investigation of a report conducted under this act fails to disclose evidence of abuse or neglect, the information identifying the subject of the report shall be expunged from the central registry. If evidence of abuse or neglect exists, the department shall maintain the information in the central registry until the department receives reliable information that the perpetrator of the abuse or neglect is dead.

(8) In releasing information under this act, the department shall not include a report compiled by a police agency or other law enforcement agency related to an ongoing investigation of suspected child abuse or neglect. This subsection does not prevent the department from releasing reports of convictions of crimes related to child abuse or neglect.

(9) A member or staff member of a citizen review panel shall not disclose identifying information about a specific child protection case to an individual, partnership, corporation, association, governmental entity, or other legal entity. A member or staff member of a citizen review panel is a member of a board, council, commission, or statutorily created task force of a governmental agency for the purposes of section 7 of 1964 PA 170, MCL 691.1407. Information obtained by a citizen review panel is not subject to the freedom of information act, 1976 PA 442, MCL 15.231 to 15.246.

(10) An agency obtaining a confidential record under subsection (2)(a) may seek an order from the court having jurisdiction over the child or from the family division of the Ingham county circuit court that allows the agency to disseminate confidential child protective services or foster care information to pursue sanctions for alleged dereliction, malfeasance, or misfeasance of duty against an employee of the agency, to a recognized labor union representative of the employee?s bargaining unit, or to an arbitrator or an administrative law judge who conducts a hearing involving the employee?s alleged dereliction, malfeasance, or misfeasance of duty to be used solely in connection with that hearing. Information released under this subsection shall be released in a manner that maintains the greatest degree of confidentiality while allowing review of employee performance.

This act is ordered to take immediate effect.

Wikipedia Accurate on Cancer Facts, But Hard to Read: Study (HealthDay)

THURSDAY, Sept. 15 (HealthDay News) -- The facts about cancer found on the website Wikipedia are about as accurate as the information on the disease found on the patient-oriented section of the U.S. National Cancer Institute's Physician Data Query (PDQ), a comprehensive peer-reviewed cancer database, according to a new study.

Although experts from Thomas Jefferson University were hard-pressed to find errors on Wikipedia, they did find the content on the site was harder to read and included links to more dense information than the simplified, shorter explanations found on PDQ.

"There are a vast number of websites where patients can obtain cancer information," study leader Dr. Yaacov Lawrence, adjunct assistant professor of radiation oncology at Jefferson Medical College of Thomas Jefferson University, and director of the Center for Translational Research in Radiation Oncology at the Sheba Medical Center in Israel, said in a university news release.

"The purpose of this study was to answer one question: Is the cancer information on Wikipedia correct? Reassuringly, we found that errors were extremely rare on Wikipedia. But the way information was presented on PDQ is more patient-friendly," Lawrence said.

Wikipedia is commonly not considered a trustworthy source of information since the writers -- whether amateur journalists or medical specialists -- develop the content found on the site without professional oversight. Nevertheless, the study found the site ranked among the top 10 results for more search engines, higher than the PDQ and professionally maintained government websites. The study authors also pointed out that Wikipedia updates more quickly.

In conducting the study, researchers chose 10 types of cancer and compared the information on the diseases' epidemiology, etiology, symptoms, diagnosis, treatment and controversial topics in cancer care found on Wikipedia with the information found on PDQ. The content on both sites were vetted for accuracy against textbooks.

The investigators also used standard algorithms based on word and sentence length to calculate the information's readability.

The study, released online in advance of print publication in the Journal of Oncology Practice, revealed that less than 2 percent of the information on either Wikipedia or PDQ did not coincide with the facts found in textbooks. The researchers found the information on the two websites were equally comprehensive. They also noted both sites discussed controversial aspects of cancer care poorly.

The main difference between Wikipedia and the PDQ site was their readability. Wikipedia was written at a college level, while PDQ was written so that a 9th grader could understand it.

"PDQ's readability is doubtless due to the site's professional editing, whereas Wikipedia's lack of readability may reflect its varied origins and haphazard editing," explained Lawrence. "Overall our results are reassuring: on the one hand Wikipedia appears to be extremely accurate, on the other, the resources invested in the creation and upkeep of the PDQ are clearly justified."

The study authors recommend that patients use the PDQ site first so they are not inundated by complex information and hyperlinks. They added that more research is needed to determine how the differences in readability of these sites affects patients' understanding and retention of information about the disease.

Spotlight on Victoria Gould | Opendoorz Business Networking

If you think accountants are boring, you?ve not met Victoria Gould. As Opendoorz? newest member, Victoria was invited to a meeting by Kate Mercer, and instantly felt at home amongst other bubbly, switched-on people.

Victoria is founder of Apple Tree, an accountancy firm near Witney. Working with small business owners and start-ups, it?s easy to see why many Oxfordshire businesses entrust their accounts to her.

Her informal, friendly approach knocks spots off the stuffy sterceotype image. In fact, Victoria?s down-to-earth style, mixed with professional expertise, is an important part of her business.

Because she deals with people?s financial situations, Victoria finds the personal touch helps clients open up to her.

This is one aspect that really appealed to Victoria when she chose to leave corporate accounting behind and focus on helping small businesses instead.

Asian stocks rebound on Europe debt hopes (Reuters)

HONG KONG/SINGAPORE (Reuters) ? Asian stocks bounced on Thursday after tentative steps by euro zone policymakers to tackle a crippling debt crisis, but investors remained wary that obstacles the bloc's leaders face could weigh on the euro and Asian currencies in the medium term.

The euro held most of its gains against the dollar after jumping on Wednesday, when Germany and France voiced their commitment to keeping debt-ladened Greece in the euro zone.

The gains in Asia, tracking a rise in global markets, came a day after the MSCI Asia ex-Japan index (.MIAPJ0000PUS) hit a 14-month low, but some fund managers were skeptical that the rebound would be sustained.

"I'm a bit surprised by the move today. I was not expecting this and I don't expect it to stay here for the whole day," said Simon Burge, a portfolio manager at ATI Asset Management.

"I haven't seen anything that provides me comfort that the situation has been dealt with yet."

Equity markets have been hammered since late July on the twin fears of renewed recession in the United States and the potential for Europe's sovereign debt woes to trigger a wider crisis in the financial system.

Japan's Nikkei share average (.N225) rose 1.2 percent, while MSCI's broadest index of Asia Pacific shares outside Japan (.MIAPJ0000PUS) gained 0.8 percent, with tech stocks the stand-out performers (.MIAPJIT00PUS). (.T)

The Nikkei was coming off a two-and-a-half year closing low on Wednesday, while the MSCI index remains 20 percent below its 2011 high in April.

Optimism over tentative steps to resolve Europe's debt crisis trumped weaker-than-expected retail sales data in the U.S., helping the S&P 500 (.SPX) close up more than 1 percent.

Some traders attributed the gains on Wall Street to short-covering -- when market players buy to realize profits on bets a stock will fall in price -- ahead of inflation numbers in the United States, with Europe still the clear focus. (.N)

CREDIT CRUNCH

European finance ministers have been warned confidentially of the danger of a renewed credit crunch as a "systemic" crisis in euro zone sovereign debt spills over to banks, according to documents obtained by Reuters on Wednesday.

The euro jumped to a three-day peak of $1.3873 on Wednesday after a 25-minute telephone call between the leaders of France, Germany and Greece which boosted confidence that Athens will received the next tranche of aid from the European Union and IMF and avoid imminent default.

The single currency's recovery was further helped after European Commission President Jose Manuel Barroso flagged plans to present options soon for the introduction of common euro bonds. The project, however, is likely to meet stiff resistance from Germany.

The single currency was steady on Thursday around $1.3735, although most strategists believe its trend remains downwards, with only short-term solutions to the crisis on the table for now.

"Nothing has changed. Greece is still highly likely to have to do more restructuring," said Joseph Capurso, currency strategist at Commonwealth Bank of Australia. He expected the euro to slip to as far as $1.3640 by the end of the week.

The dollar edged 0.1 percent higher against a basket of major currencies. (.DXY)

Talk of foreign investors pulling money out of Asia on concerns another global credit crunch may be looming could weigh on regional currencies. Earlier in the week, traders reported heavy fund selling of Asian currencies.

The gains in Asian stocks put safe-haven bets such as gold under pressure.

Spot gold slipped around 0.4 percent to about $1,813 an ounce, after falling nearly 1 percent in the previous session. It hit a lifetime high of around $1,920 an ounce last week.

Oil was little changed, with Brent crude edging down 21 cents to $112.19 a barrel, while U.S. crude lost 22 cents to $88.68.
